I got I-140 RFE (EB2) regarding my education to prove the Bachelor degree I have is equivalent to US Bachelor degree. I have 3 years bachelor degree they are saying US Bachelor degree is 4 years.

My Lawyer is still working on it. I dont have say more than this that my freaking company is slow, unprofessional, irresponsible and typical exploiting consulting company.

My company qualifies for one of the company to be blacklisted. (There are lot of other incidents not only this I-140 RFE delay) :-)

what does this mean? does that mean my computer needs to be down-graded to DirectX 7?All versions of DirectX (except 10) are supposed to be fully backwards compatible with previous versions, so you should never have to revert.

    Backlog Cases:
    Total Received: 363,000+
    Total Completed: 108,000+
    Total Certified: 50,000
    Balance: 255,000
Full data entry will will be completed by 06/30/2006 as scheduled.

    PERM:
    Total Received: 80,272
    Certified: 36,587
    Denied: 23,305
    Audit: 24,960
    Withdrawn: 1,950

Now look at the maasive backlog of unprocessed cases in BEC. The Baclog Centers have received more than 363000 LCs and out of it 255000 are still untouched. given this pace they will take at least 5 yrs to finish processing all the applications. and DOL has added a graphic on their website claiming 18 months to go. They are just making FUN of US for yielding to their beaurocracy.

Today me and my wife got our CPO emails. Mine was filed in Eb3 and my wife's was in Eb2. I got my approved though my wife.

I've been in US for 10 years... now i've two things to do

    1. Wonder was it really worth this wait.
    2. Move to the citizen line.

thanks IV, for all the support.

I'll not be going anywhere..My life has been on IV for all these years and now i don't know what to do because I've been addicted to come to IV every hour of my life these past years. I still remember pressing F5 during the july fiasco bulletin.

Congrates! This may be useful information for you: check it out (http://immigrationvoice.org/wiki/index.php/US_Life_After_GC)

That was a huge sigh of relief. Thanks and I really appreciate your answers.
Hopefully, I'll get my EAD (PD is April 2007 on EB2) before they respond back with MTR response.

Well, I don't see a problem with that. If you can file 485 without clearing 140, why can't you file 485 without clearing labor?

We should stay modest? There are a lot of us who have waited 4+ years for labor. I think that's enough modesty and patience.

Hey, "modest request" in my post does not translate to modesty and patience. Just thought I'd point that out.

Like this one a lot. I agree with Queen that it would be interesting to see one of the pots colored. Might try rotating the image so the pipe on the right is vertical. 2 deg. CW did it for me. Squares up the image better. Nice shooting.

I have a somewat similar situation, here goes:

Myself: "Resident Alien for Tax purposes" for 2007.

My wife: Before we got married last year, she was on J1 (> 6 months)
Therefore, that time does not count towards calculating presence in the US for tax purposes. This implies she is a "Non Resident Alien for Tax purposes" for 2007.

The 1040 instructions (http://www.irs.gov/pub/irs-pdf/i1040gi.pdf) state that you cannot file as "Married filing Jointly" if either spouse is a "Non Resident Alien" for tax purposes, UNLESS the other spouse is a citizen or a permanent resident. (Page 13).

My thought is that I will have to go with "Married, filing separately". Since my wife did not have any income, I may be able to take a deduction for my spouse(Page 14), if she doesn't file her taxes.

You are correct that if you file jointly, the difference is quite a bit - but I am not sure what else one can do.

If others have dealt with a similar situation, please advise.

    Thanks.

    Ams

Can we file taxes seperately on married status?

I mean, my CPA did estimates seperately and we found substantial difference...

Is there any problem in we filing seperately as we r into 485 peding stuff?...
From an Immigration perspective, what are the ramifications when 'Married and filing Jointly' versus 'Married and filing seperately'.

First of all, are they related?

My lawyer and I both tried using this link but we keep getting error messages.
Has anyone got any updates on their cases on this link?
Yes, I told my lawyers next day after the site was opened and they confirmed that my case is in the system and "In Process," although, In Process is a very broad term it does not tell me where in the queue my case is, when it will start to be worked on, i.e. the time factor and estimations are missing. It is really bad, bad system ;-(

If you look at the typical client letter RFE they normally state that your comapny is in consulting practice. So if your comapny's product development practice is big then try to file the new H1 with a detailed covering letter which detail both comapany practices stating that you will however work in product development. For your specific project try to have project plans or MPP showing your role as part of your petition details over the project duration. All the very best.

Can you please provide me a bit more insight for this topic or please point me where i can get some more details, if possible.
I'm on H1B 8th year, stuck with EB3 Retro with a priority date of Nov/03. My wife has a PhD in Molecular Biology, one of the hot subjects all across the globe.

    I'll truly appreciate
Also why dont you apply in EB1 Thru your wife in parallel to ur own GC. PhDs dont need an employer to sponsor them.

Note that you cannot legally be required to reimburse certain immigration fees such as the $1500 or $750 ACWIA fee. Also, you cannot legally be required to reimburse USCIS filing fees and/or immigration related legal fees which, when subtracted from your salary, bring your salary below the required LCA wage.

I got the 140 denial notice.
The USCIS did not mentioned any reason like my valid labour is expired. Not sure is the denial is because of 180 day rule or not.

    Here is the reason...

The petitioner did not submit an individual labour certification for the beneficiary or evidence of schedule A designation. As such, the beneficiary is ineligible for classification as a member of the preofessions holding an advanced degree or an alien of exceptional ability.

I think the first line "The petitioner did not submit an individual labour certification for the beneficiary..." is relevant to your suspicion of an expired labor. It effectively says that there are no valid labor certification against your I140 application, which means that the Labor certification you filed your I140 against, is not valid anymore.

Please restart your Labor again, ASAP.
