    Too many times such stuff has been said and always proved to be hot gas from from some politicians mouth.
    All this while EB suffers.
    An illegal is still going to do a $8/hr job, whether you give him a green card or not. He is still not going to pay taxes because he will get paid in cash. All that will change is that the illegal will be able to send sponsorship for his 50,000 cousins and uncles.
    EB will continue to suffer..as always.

    illegals often pay tax actually. They work with fake (made up) ssn numbers and the tax
    is sent to IRS under that SSN. Lately in bush 2nd term and now Obama they are sending no match letters because the sin umber and the date of birth and name that is reported to IRS does not match with what they have in their system.

    However CIR is an impossible task in 2010. Other that some political show by Hispanic Caucus, it has no purpose.

    Education evaluation is just equating your qualification with American qualification. Just telling your bachelor degree is equivalent to BS here. Once equal...always equal. So it doesn't expire.

    I just read this line from the USCIS release

    ===

    USCIS�s announcement today allows anyone who was eligible to apply under Visa Bulletin No. 107 a full month�s time to do so.

    ====

    It appears Labors approved after July 31 cannot apply for 485 as they would not have been eligible under bulletin No. 107.

    if yes, then this is something that should be clearly mentioned somewhere.

    I start to study WOM, my district court web doesn't list anything about that, then I find aonther site lists WOM cases filed in my district, but no status mentioned. Does anyone knows? I appreciate!

    Hi,

    My I-485 currently pending which was filed based on Approved I-140 (employment based).

    My sister also had filed I-130 (Petition for Relative) on my behalf, whose priority date has become current
    in last Aug 2009.

    My Attorney had sent letter to USCIS requesting to Transfer my pending AOS from Employment to Family based,

    (AOS Interfilling) in november 2009. She sent another letter in Jan 2010.

    I called USCIS three times to find out the status on my application. My attorney has also called two times.

    There is no change in my status at all, the USCIS don't even confirm that they have received any letter for
    Interfiling my application.

    They tell me to call the service center where the letter was sent. Is this possible ?

    When my Attorney sent the AOS Interfilling Letter, She did not send I-864 (Affidavit of Support)
    with the Letter. When I Asked her, she said as per parson's memo only the letter is required. Is she correct ?

    If anybody has similar case, please advise me.

    I don't know what to do ??? Should I wait for the response from USCIS ? , should I Change the Attorney
    or Should I take Infopass Appointment.

    It has already been four months since my attorney has sent letter, and I don't see any progress from USCIS.

    someone plase help me.

    My company would like to send me France on business.
    But My H1 visa expired Jan 2006.
    I got H1 approval up 2009 but passport is not stamped.

    My lawyer told me that I can go to Paris (France) and visa stamped.
    I am not sure France consulate will issue me visa to enter France.

    Any comments and any input?

    Hi all,

    What docs are required for re-entry of spouse on H4 visa. The primary applicant on H1 is not travelling.

    1. Copy of I-797 of H1 visa holder.
    2. Passport copy of H1 visa holder.
    3. Recent pay stubs of H1 visa holder.
    3. Marriage Certificate.

    Am I missing something.

    Not sure you need any of 2, 3 or 4. However, it is very helpful to have a letter from the H1 employer saying that you are still employed by your company or whatever you work for and your spouse is currently on an H4 dependents visa.

    My husband has found this has been adequate on many occasions.

    I'm not sure the need of physical office for GC, but for H1 transfer and extns you may get RFE for office photos, lease agreement (notarised copy) etc.

    All,

    We are closing our physical office and going to have a virtual with PO box,. Please let me know how it will impact current and future H1s, Greencard filings and L1s and Business visas.
    Is it very important to have a physcial address in the US,

    Hi,

    I was wondering if there is a limit on the # of travels for each AP approval. I received 2 AP documents valid until May 2010. I have already travelled twice. On my first return the immigration officer kept my AP document at POE (NY) but the 2nd time it was stamped & returned (Washington DC was POE) to me. I was wondering if I could use this document for subsequent re-entries or do I have to apply for a new AP.

    I have a valid AP approved on Oct 13, 2007. The H1B visa stamped on my passport expired in Mar 2007. I have a valid one year H1B approval till Mar 2008. I do not have the original I797 approval notice but have a scanned copy of it. Now if I have to travel out of country in July and enter back on AP will there be any trouble at the POE with not having the original approval notice of last H1B.
    Any inputs will be appreciated. Thanks

    I came back from India last week, JFK was the Port of entry. All i showed them was the AP and my passport, they did not even ask for any other details. Infact all your details will be in their system which they will verify inside.
    I would not worry about it, but do carry your 485 filing reciept (i was never asked for one).

    Since your h1b transfer is approved, there is nothing to worry; and your pd will remain the same. good luck.

    I had a question about using using AC21.

    Here is the scenario: Let us say I work for XYZ Company who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
    If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved, what happens to my 485 application?

    Wouldn't USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?


    Please advice!
