Please remember here that earlier employer could use ur I140 for other employees but that rule was also changed in 2008. I140 once approved, you keep I140.
Revoking I140 is not good for employee as it is his application to USCIS in this process and will put him in problem for other employees sponsorship.

Yes. I did contacted both Kerry and Brown's office last month (July end) for my EAD renewal application.
Both office staff were very receptive. Brown office has more than one person working on immigration matter....and I believe they were first to act on my case. I got EAD approval 4 days later.

Buddy, you will need to send only one AR-11 but will need to call in your change of address for every application. One phone call will cover it all, but make sure you tell the Customer service person that you needed this to be changed for every case. Then you will get a confirmation letter at your mailing address for every case that you changed address on. That is what I had to do on my 485 and EAD application.
Also if you have any dependents over 21 (like spouse) then make sure your spouse is next to you or calls in separately to the Customer service. They will not allow you to speak for your spouse. You could do so for dependents under 21 though.

I have a friend in India who applied to a new H1B through a consultant, was lucky to get through the lottery but is now stuck in RFE because of issues with the consultant. He heard from someone else that the same consultant is getting rejects and is nervous that his case will get rejected too.
I've heard that while a H1B case is pending (before it is denied), one can apply a separate petition from another employer and is still considered a valid application that is within the quota as it is for the same applicant.
Does anyone have experience in this area? What do you recommend? I also plan to contact an attorney regarding this to help my friend.

Hi,
Me and My friend developed a product, which is ready to launch. The product is very good and two fortune 500companies are willing to implement the product and back us up.
Now my problem is I am on H1B working fulltime with a company and also have an EAD. At this moment I cannot leave my fulltime job. My question is , if I can be a partner with my friend in the new company we are forming( My friend is a US citizen), also will I be able to get paid ( as the developement of the product drained my pocket, this was the hope and I think we are close to reap the hardwork) . Also my wife is also on EAD , can she be the partner? Will there be any issue if I can do that.

Yes, this should be possible assuming your priority date is still backlogged. If not, you can at least get the unused part of your 6 years.

I am currently out of USA.My new employer has submitted H1 Transfer and extension of stay.
The petition has been approved along with new I-94. I have the original I-797 with me .
I understand that we have to surrender I-94 before leaving USA.But in my case I got I-94 after I left USA.Now I need to go for visa stamping in India.
Should I submit the new I-94 to the US consulate in India?
Please advise.

My application for an H1B change of status has been denied. I am an F-1 student from Colombia and I was offered a job from THe CDC at Atlanta. According with the USCIS report, the petition was denied because I am going to be hired for a staffing company and not directly for the CDC. It will be possible to appeal the desicion ? My attorney is about to file my I-1485 this week.
My details:
Previous company:
Perm PD: June 2006 EB2
I-140 EB2 approved in Nov/2006.
Current company:
PERM filed: Oct/24/2007
I-140 EB2 filed on Jan/31/2008
trying to recapture the old PD of June/2006.
Today, when I checked my I-140 status, it says "Request for Evidence sent" yesterday.
What are my options now? I do not know if I am eligible to go ahead and file my I-485 now ? What are the implications if I go ahead and file my I-485 now.? Please let me know your ideas.

My roommate is from England. She applied for a work visa, I'm not sure which number or letter, but anyway she was supposed to apply 90 days before her studies ended up to 60 days after. She mistakenly sent the application in 94 days before she finished her studies and they denied it because of that.
I read the form and it said there is no appeal. She went to try and take care of it today and they told her not only is there no appeal, she can never apply again. Is that really right? For a simple mailing error she can't ever get a work visa now?
What other options does she have?

Can anyone tell me after my 6th year of H1 i have a 3 year extension of h1 visa, can i go to india and come back on that visa or do i need to have AP. I got my 140 approved and i got my 485 receipt notices.
you can use the visa, need not use AP if you dont want to. If you have a visa stamping already, using the H1 visa is the preferred way to return:
- you get an I-94 valid for 3 more years (with AP you get one for just one year, which is a bit weird)
- using AP atleast sometimes pushes you into secondary inspection which is another hour spent with the customs and border patrol folks. While they are typically nice and friendly, I personally hate being stuck in that no-mans land at the airport.
Only advantage of AP is if your GC is approved while you are abroad, you are supposed to return on AP as your H1 status would have ended. in practice people have re-entered on H1 in such cases and its been ok. Depending on your PD this may not may not be a concern

If you accept the employment with lower salary using AC-21 and if any RFE comes for Employment verification then you will not be able to respond to the satisafaction of USCIS on why you are working on the lower wages.
Hope this helps you understand the importance of keeping job position and slary level consistent with what its in your approved labor.
