I Left Company A on April 27, 2004. Joined Company B on April 28 through H1b Transfer as CompanyB told me that they have filed H1b transfer documents. Got H1b Approval in Few months; , The H1b approval notice shows a receipt date of May 15. CompanyA never reported my job termination to INS. Now i have left Company B and joined Company C. Can anyone comment on consequence of this 17 days gap on GC prospects and What is considered my employment start date for companyB and employment end date with CompanyA.

Per Cronin Memo, your wife is eligible for H4 visa.
This is based on the feedback from a top attorney.

Maybe USCIS would earn more income by telling the illegal immigrants to file EAD/I-485/Biometics every year etc.. Immigration attroneys would earn good money by replying to RFEs for 12 million immigrants. Getting this 12 million illegal immigrants legalized will surely improve the economy.
Everybody would be kept in the same backlog as we are. Illegal immigrants will stand in a que behind the legal immigrants. so you got the point

with 90 days validity and I have not seen my receipts or checks cashed yet.

My lawyer replied to 90 day validity. He mentioned that if at time of sending documents if the check was valid and had not expired then application should be accepted.

Also he mentioned that with so many procedural errors being overlooked in this last July visa bulletion, this has to be looked over, since this is not a problem of candidate sending documents.

And there is nothing one can do about it, so i am thinking it will be alright.

    We will be fine.

    Hi,

Im in EB2 and My I-140 was approved September 2008 through Employer A. And I got laid off on November 2009 from EMP A, within 15 days I joined another Employer B. As per policy, employer B is not going to file GC for me. Already I spend 5 years on my H1B. I check with EMP As HR dept, they will not revoke my I-140 and H1B. I know AC21 is one of the options to transfer (Portability) my PD to Emp B after apply I-485.

It would be great if I get answer the below my Question:

    1. If my PD is current, Will I eligible to apply I-485 using Employer A I-140 approved?
    2. What are the documents needed from employer A, if I want apply I-485?
    3. All my friends telling me, I can apply I-485, Is it true?

    Tons of Thanks,
    Ramkumar

    Hi

I concurrently filed both my I-140 and I-485 back in Oct 09. My I-140 was approved on March 18th and then nothing since. I read that by concurrent filing the process is quicker. I am on an EB1-C. My question is has anyone had any experience in the time frame for concurrent filing under the category i am under? I have checked the tracker and cannot see anyone in similar position. Time line is what i am looking for or is it a "wait and see" situation?
    Thanks

I do not know if this has been posted on this forum..
But some of the testimonials are interesting for Students & STEM based EB applicants..

    This is from Immigration-law:

02/14/2008: House Subcommittee Hearing on Status of Visas & Policies on Foreign Students and Scholars on February 7, 2008

The House had this important hearing that can have an impact on the employment-based immigration issues relating to the STEM foreign graduates in research and higher learning institutions. It is suggested that the EB immigrants in STEM to review the testimonies of witnesses in this hearing.
Purpose and Summary of the Subject
    Testimonies of Witnesses:
:: Opening Statements by Rep. Brian Baird
    :: Witness Statements ::
    Mr. Tony Edson
    Ms. Catheryn Cotten
    Dr. Harvey Fineberg
    Dr. Allan E. Goodman
Under the current political environment and a long pause in the employment-based immigration legislation issues in the Hill, this is indeed an important news in that at least the Congress is giving attention to the predicament the research and higher learning institutions are facing owing to the failure of the do-nothing Congress and the Administration to act on the matter.

Does anyone know if the B1 visa can be extended in US? The visa stamp on the passport is for 6months. when entered US, the officer granted 5.5 months of stay.......

I am thinking I simply appy for B1 extension 30 days before I-94 expiry date and the actual visa stamp on the visa does not matter.....is it true

    Thanks for your time!!

    Guys,

I was laid off from GC sponsoring employer and my previous attorneys may have withdrawn their G-28. Now I have started working for new employer but have not filed for AC21 yet. The new attorneys have sent G-28 forms (so they claim).

Now I really want to move from the place where I am living so that my commute is shorter for my new employer and am also having lot of problems in the apartment condo where I live. But my concerns for moving are:

    1) Does submitting Ar-11 online , update the address for your pending I-485 also? I have read few stories on the net that people who moved during I-485 and also updated their address still got an RFE at old address OR even worst the USPS returned the notice saying the person does not live there anymore

    2) I have also heard that sometimes the new G-28 forms does not reach your file and RFE/ NOID may goto old attorneys .

I have these two concerns because my previous employer is going to revoke my I-140 which is going to result in straight denial of I-485 and even if I need to file MTR I may not get the notice in the mail because I may have moved.

Is there anyone who has been in this situation or moved after filing I-485 and successfully updates their addresses so that they get any RFE/NOID/Denial at new address.

Anyone else who can tell me about a good attorney in Chicago area, it is urgent for me to contact a good attorney as there is a mistake in 485 application.

    Thanks...

    Hi pkrg21,

So before I-485 becomes current, as long as I-140 gets approved, then we are okay to lose current job, either laid off or change job? I think I-140 approval doesn't take long, right? It's just I-485 takes forever?

I'm quite new to this process. My employer just filed Labor Certificate last week. I'm also a little worried if my employer goes bankruptcy some day.

    Thanks,
    ~ray

No the process must be completely restarted if you loose your job after I-140 approval. The only thing you get is the priority date.If your I-485 is already applied and it is pending for 180 days then there is no issue and you are safe.

Start with Libra. I have seen people talk, talk, talk and talk about immigraton and gone with the wind right next day they get the green card. Start with a member 'libra', he always used to blame eevrybody, not seen since the day he got his GC. Share some other names.

You are only trying to settle personal scores. Maybe the member touched your nerve sometime?

But let us look at you first. How about you speak for yourself. What have you done to help IV till now.
