I was under the assumption that you cannot file for EAD unless your I-485 application has been filed. How come Amit1234 applied for his EAD, his priority date is Jan 04 EB3. Just curious.

Your priority date is the same as your husband's. It will be on your husband's I-140 approval notice.

We are indian nationals living in the US - I have an H1-B visa with visa stamp valid till 05/2010 and my wife is on H4 - she has a valid 797 but does not have a visa stamp yet

PLEASE HELP ME WITH ANSWERS ON ADJUSTMENT OF STATUS, APPROVED I360 VAWA AND INTERVIEW?
I just received an approved i360 vawa petition from VSC dated January 26, 2011. The petition was approved on December 20, 2010 and I have a pending I485, filed on January 2010 and I asked the local office during my interview to hold on to it till my VAWA I360 is approved. Now, my VAWA I360 has been approved, I would immensely appreciate your kind help if someone can help me with the following questions.
1. How long does it take for an approved VAWA I360 to get notified to National Benefit Center to link my pending I485 to my approved I360?
2. Has anyone ever experienced this situation and how long did it take before securing interview notice?
3. Do I need to contact the local office since I suspect my pending I485 should be at the NBC or do you think its been transferred to local office.
4. My work permit EAD is expiring on March 9th this year and I would like to renew it since I still have a pending I485 since April last year and approved I360 this year. Do you think I have to renew my EAD since I'm hoping to secure my green card soon rather than paying another $380 this week for my work permit renewal?

You don't file a G-28 unless you DO have a lawyer representing you. You just need to write to CIS advising them that the former lawyer no longer represents you, and ask CIS to send any correspondence directly to you, not the lawyer. It might take a long time for CIS to make the change, but in the meantime, the other lawyer should send you anything he gets on the case.

Hi all, apologies first off for not knowing all the technical USCIS lingo, but my question is relatively simple.
Situation: I am a US Citizen and I'm planning to marry a non-US Citizen in October. He is from India, currently on H1B, has the EAD, and is now patiently waiting. I don't know his priority date offhand, but I do know that he applied during all the crazy hubbub that happened in July-August 2007. (wow, it's been almost 2 years? time flies!)
Our marriage is totally legit, we've been for 5 years, living together, etc. What we need to know is, would it be better to forget the work-sponsored GC application and go for a family one? Or can he have applications for both at the same time? Would changing to a different type of application affect his ability to continue working at his current job, at all?
Thanks in advance for advice anyone can give.

My question is has anyone had any experience in the time frame for concurrent filing under the category i am under? I have checked the tracker and cannot see anyone in similar position. Time line is what i am looking for or is it a "wait and see" situation?

Please provide us more information. If you are working as a manager in IT and especially from Indian companies, USCIS is investigating the EB1C cases as there is rampant corruption and manipulation. I am not sure what you mean by EB1-C - is it china or EB1C.

1. Would there be any adverse effect if in future Company B files H1B for me ?
2. What generally happens if I file H1B and am not able to attend the interview ?
3. Is there any way Company A can revoke the H1B petition after I resign before H1B interview ?
Would appreciate a quick a reply .
1. There shouldn't be any negative consequences if you change from one H-1B employer to another. People do this all the time.
2. What "interview" do you refer to? If you mean a visa interview at the consulate, you should cancel if you cannot attend.
3. Company A can and should withdraw the H-1B petition once you leave the company. This should not affect you getting new H-1B status, assuming there is no major gap between leaving Company A and Company B filing the new petition.

Priority Date comes first, and then country limit. Country limit is not respected at the last quarter of each Visa Year (July to Sep).
If you're on EB2, then you're on for approval as soon as everything clears (security check, etc.). If you're on EB3, wait for a while dear. It will not come soon.

There is a change of status form available on USCIS website. It is called I-539:

Go through the instructions of this form. I followed the instructions in this form and sent every document they asked for. My wife also changed her status from F1 to H4. After you send everything, you will get a receipt in 2-3 weeks and approval notice will take ~3 months.

My priority date is in Oct 2005 (ROW) and yesterday was the 180th day after filing my I-485 application. I need some help in deciding if I should wait for the green card with my current employer or think of changing the job using AC21. Your suggestions will be really helpful.

check the next VB (should be out in a day or two). Based on a thread where someone found the dates from the Mumbai consulate website, EB-3 ROW might move to July 2005. if it does, it might be worthwhile hanging on a couple of more months to this job and see if you become current.
On the othe rhand if you get a really nice offer, jump. AC-21 only adds a bit of complication to your job, it does not prevent you from getting a GC.

AILF is seeking plantiffs. Please show some spine & courage. If your employment history and everything on your green card file is clean, volunteer for becoming plantiff. I have a gap in employment otherwise I would have surely volunteered.
Thought AILF already has enough plaintiffs - this was last week's news. Anything changed or they just looking to add more plaintiffs?
It would be good if someone with a compelling story comes forward (I have a normal story but still i will check with my company/attorney if there are any objections if I join as plaintiff).
