Hi..
I came to US on H4. My H1B got approved when i was in India. But I came through H4 only.
Now i want to change H4 to H1B. If i want to apply for change of status..do i need to go back to india(ot other countries) for stamping? Or can i get H1B staying here?
Please help..

Hi.
I am planning to invoke AC21 via H1B.
My old employer have no issues continuing the same attorney for my future needs.
My new employer asked me to go with their attorney... but I am planning to go with my old guy who applied my 485.
Can I pay AC21, future expenses etc charges from my pocket since I am going with my old attorney.
Is it OK to me paying fees for the GC instead of Employer? Or I shud go with New company Attorney?
Appreciate your help on this.

well if there's a way for you to get your approved labor certification doc, or even the copy of the filed labor application; then definitely get it.
The labor app has the exact job description too. So if you do use portability (ac-21) it'll help to match it with the job specs of the new position.

They might have moved all non - preadjuicated files to NSC. TSC has nothing to process so may be close to current in processing time.
NSC will be overloaded though..

Use latest I-94 from H-1 as the old I-94 is supposed to be old after the new one arrives with the H-1 approval ...

Yes. I have been getting this message when I login from work as well as home computer. I generally check my EAD application status once every 2-3 days and yet USCIS thinks that is an "excessive" use. I am pretty sure they have some issue with the website.

one lawyer whom I spoke with says it is still ok...basically they need senior applicants in their field who has done some supervisory work and can do managirial work..I don't know how much it is true.

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I graduated in Romania Bachelor Degree in Mathematics & Computer Science (4 years) and Master Degree in Computer Science & Engineering (2 years). My work experience is more than 7 years. My daughter is 2.5 years old and is on H4. She is receiving some modelling offers for commercials and photo prints. I understand since she is on H4 she cannot work. But can I apply for her EAD and work SSN by which she can work on these assignments?
I am looking at this purely for my daughters personal development and no big money is involved but still I dont want USCIS to think she is working even though she is on H4.

Unfortunately, there is not going to be a hard consensus and a good satisfying answer until USCIS comes out and fixes the law. The problem comes from inconsistent USCIS memoranda as to whether an employer who moonlights on EAD has "left" his employer.
AILA has recognized this inconsistency and has provided us, immigration attorneys, with guidance on arguing why the inconsistency should be construed to mean that moonlighting on EAD while preserving H-1B is ok; however, nobody can guarantee that the USCIS will agree with these arguments 100% of the time.

Will they send an RFE immediately even after the I-485 has been pending for more that 180 days?
depends on the officer. A lot of officers do not know the AC21 law. As soon as they see 140 being revoked, they blindly send denial notices for 485 and you have to correct this through MTR.
After a 140 revocation by ex employer, it takes a few weeks for USCIS to act.

my self (h1 holder) and my spouse (h4 holder) currently out of country. 485 approved for h1 holder. but AOS is still pending for h4 holder. H4 holder does not have AP.
What happens at POE ? We both have valid h1 and h4 stamping but no AP. are we allowed to re-enter on H1 and H4 ?

I am having the same issue.Applied AP online on 1/10/11.Got receipt no and Application as PDF.I have the Receipt no and sent all supporting document with LINXXXXXXXX no.But I have been trying to add the case no to my profile and it says not found.I am not sure what can I do or wait for more days.
