    Mine is approved I140. If USCIS doesn't ask for paystub then giving EVL of any consulting firm will solve the problem?

    Also, my wife is working on EAD. Can she apply for H1 visa? Will it affect our GC process? I am the primary applicant.

    A bonafide job offer is what is needed. You may want to contact lawyer personally and they will be able to guide you in this.

    Also here is my next question. When my H1B extension is pending, can I change my employer? Should the new employer wait for my H1B that will be renewed or does the new employer apply for a fresh H1B renewal? I guess he cannot do this because I will out of status for 7 months and this might turn out to be illegal. Someone plsssssssss answer my questions!

    Recently, one of my co-worker who was on L1A, requested an extension of his Visa. His employer filed for an L1B instead and did not inform him until after filing it. Now USCIS has sent an RFE. Does anyone know if this can be grounds for rejection of his Visa? Is the employer legally correct in filing a changed Visa category at will without informing the holder? His wife is unable to obtain a driver's license since the Visa approval is pending. Does anyone know if this can be addressed? If so, how?

    You are eligible for 3 years extension with the approved I140. I also applied my H1 extension by attaching approved 140 for 3 years extension, I got it last month...

    it will not like 2 yrs and then 3 yrs.....go for 3 years...I think lawyer should know all these....

    The fingerprinting is generally scheduled to give enough time to the personnel at the center to do their job comfortably and not have a large waiting line. From my experience I found that the scheduling is loose and so the folks at the centers can accomodate an extra person very easily. Also these are contractors who get paid by the number of cases so they are okay with doing a fingerprinting if you turn up on an unscheduled day.

    The best bet is to turn up on a weekday. I did this for both myself and my wife as we were headed to India the day our fingerprinting was scheduled. There was no one in line and the whole process took at most 10 minutes.

    I've been patiently waiting for ___ Years for my green card now, I came here legally and have always followed all laws of this land... I'm really disappointed and disheartened by what I see and read about the immigration reform bill.

    All I ask is... (discuss all 3 issues or even 1 that you think will keep it simple and get your point across)

    1) INCREASE the number of EMPLOYMENT-BASED green cards for LEGAL skilled immigrants who are currently backlogged. We request the Senate to ELIMINATE the backlogs BEFORE starting a new merits based system.

    2) Urge the Senator to AMEND section 501(b) and INCREASE the number of EMPLOYMENT-BASED green cards for LEGAL skilled immigrants from 140,000 to a higher number to ELIMINATE the current backlogs, the SAME way the bill REDUCES backlogs for family-based immigrants in section 501(a).

    3) Oppose the senate’s immigration bill in its current form because it reduces the number of green cards for legal skilled immigrants. It diverts these green cards to the proposed future guest worker program and to a proposed untested merits based system.

    Hi,

    Can anyone share the experience of H1 Visa stamping in Hyderabad. As per their web site they need quite a lot of documentation. Not sure if such doecumentation is required for visa revalidation (same category - H1) as well.

    EB2 is reduced 11K+ in 4 months and EB3 4K+.

    can you post the numbers for CY-2006 and CY-2007 for India and China.
    that will give us an idea how the volume moved.

    Hi Gurus,

    Thanks for your time on this post. I appreciate your responses.

    I have a question regarding AP. I have AP's based on my pending 485. Recently i traveled to India (on a family emergency) using my AP which was issued in 20th Nov 2008 valid till 19th Nov 2009. I had no issues & got thru JFK using the same.
    I was out of US from Sep 23rd thru Oct 24th 2009.

    Before leaving US I applied for my AP in early Sep, which got approved by Sep 29 and was in my mail box by the time I arrived. The New pay roll has validity from 20 Nov 2009 until 19 Nov 2010.

    My question is, I may need to travel to India again for couple of months that is some some time near 5 Nov 2009 & will be back by Jan 2010.

    Do you guys foresee any other issues? , I herd that the AP is NOT valid if you are out of the country.

    AFAIK, your new AP is valid and usable; get a second opinion from an attorney. Re-post in attorney's section.

    I have a pending I-485.
    My case was file in jan 02. I have approved labour and I-140. I filed my I-485 in Jun 2005 and have an EAD and parole. How do I find when can I file my spouse's case.

    You PD has to be current to file I-485 for you spouse/dependent. Since you filed for I-485 in Jun '05, and based on ur PD, i guess ur case must be EB2. If EB2, then you are in a better position alteast compared to many folks here.. The PD for Mar '06 per DOS, Visa Bulletin, for EB2 is 01JAN02, Since your case has a PD of Jan 02, (Date not provided by you),

    Watch for April VISA BULLETIN, The DOS publishes this ususally sometime in first 2 weeks of each month for the following month. If the Date moves forward you should be able to file sometime in April, assuming the Date moves forward. Also you can use this time to prepare the application.

    My status on I-140 changed to "Request for Additional Evidence". Notice was sent only on 25th, so I don't have any more details yet.

    Just wondering if anybody has any idea what it could be?

    google around for RFEs... the three most common ones are:

    - ability to pay -> this is for your employer to prove... if you are from a small company, or have been paid less than prevailing wage or LC wage, this might come up.

    - education qualifications -> if your LC said the job requires 4 year BE in CS, and you have a 3 year BSc in Mathematics, this might come up

    - experience letters -> if your LC said the job requires 5 years of experience, and you have not submitted detailed experience letters for those, you'll get this RFE.

    Having said that, dont worry about it until you actually receive the RFE, it could be for a bunch of things, some serious, some completely trivial. If your LC required some minimum experience and you did not submit copies of your experience letter, you may want ot start contacting older employers, otherwise just wait till the RFE actually comes.

    if you get fellowship, you dont have to work. TA/RA has to work, which needs authorization. Just for taking classes should be ok...disclaimer applies :)

    Not a lawyer- but my guess is that the date of validity on your H1b (First H1) is the day you can start counting your 6 years. This is regardless of when you started working for your employer.

    Example: Employer sponsored H1 for Mr.X on April 2nd 2005. H1 approved with validiity starting 1st oct 2005. Mr. X flew to the USA in december 2005. Started working 15th jan 2006. The 6 years are counted from 1st Oct 05.

    Now one can recapture all the months that the employee was on vacation. But I am not sure if this is still an option.

    The six year count starts from the day you entered the US first. If you take the above example, six year count starts from December 2005. Additionally, if there is gap from the time you entered and started working that period is considered out of status, that's all together different issue.
